About This Pillar

To ensure every resident in Laikipia East has a secure, undisputed title deed, we need a proactive, community-led program. 1. ​The Core Challenges (2027–2028) ​The Digital Divide (ArdhiSasa Transition): While the national government is pushing for a 100% digital land registry by 2029, many rural residents lack the “ArdhiSasa” accounts or the technical knowledge to navigate the system, leading to “digital dispossession.” ​Succession and Inheritance Backlogs: Thousands of parcels are still registered in the names of deceased grandparents. Without formal succession, youth cannot use this land as collateral for agribusiness or development. ​Boundary Disputes and Overlaps: In areas like Umande and Ngobit, manual survey errors from previous decades have led to overlapping titles, which often stall in the Environment and Land Court (ELC) for years. ​The “Squatter” and Settlement Scheme Crisis: Unresolved historical claims in former colonial ranches and pending regularization of settlement schemes continue to leave families in a state of tenure anxiety. 2. ​The Mitigation Program: “Haki na Ardhi” (2027–2032) ​This program focuses on Alternative Justice and Digital Inclusion to bypass the slow traditional court systems. A. ​The “ArdhiSasa” Ward Clinics ​Instead of residents traveling to Nanyuki or Nairobi, the Technopolis Hub will deploy mobile units to every ward. These clinics will: ​Help residents create and verify ArdhiSasa accounts. ​Assist in the digital “conversion” of old manual titles to the new digital format. ​Scan and upload historical land documents to secure them against physical loss or fraud. B. ​Accelerated Succession Program ​The program will partner with pro-bono legal teams (like the mentioned Banson Njau Advocates) to hold Succession Barazas. ​Bulk Processing: Instead of individual families struggling alone, we will group succession cases by sub-location to allow for “circuit courts” or mobile magistrates to resolve them in bulk. ​Fee Waivers: Lobby for the waiver of land search and transfer fees for families earning below a certain threshold to encourage formalizing ownership. C. ​Alternative Justice System (AJS) for Disputes ​We will formalize the role of Community Land Elders as the first line of defense. ​Mediation over Litigation: Boundary and family disputes will be funneled through an AJS committee before they hit the courts. Under the Mediation Act of 2020, these settlements can be registered as court orders, providing a legally binding solution in 60 days rather than 6 years. ​GPS Boundary Mapping: Use Hub-trained technicians and modern GPS tools to re- demarcate boundaries transparently in the presence of neighbors, reducing the need for expensive government surveyors. D. ​Protecting Community and Women’s Land Rights ​Spousal Consent Enforcement: Ensure all land dealings at the Hub or Registry level strictly enforce the requirement for spousal consent, protecting women from the unauthorized sale of family land. ​Community Land Registration: For areas transitioning from group ranches, we will provide the technical and legal support to ensure the land is registered under the Community Land Act, preventing “land grabbing” by external cartels. 3. ​The Roadmap to 100% Titling ​Year 1 (2027): Launch the “Land Audit” – A ward-by-ward mapping of all untitled or disputed parcels in Laikipia East. ​Year 2-3 (2028-2029): The “Digital Conversion” wave – Ensuring every manual title is moved to ArdhiSasa and every family has a digital identity. ​Year 4-5 (2030-2032): Final Adjudication – Settling the remaining complex historical disputes through the National Land Commission (NLC) and the newly reinstated Historical Land Injustices window. ​Why this matters for our 2027 Vision ​Secure land tenure is the bedrock of your Technopolis Hub and Agribusiness plans. A farmer with a title deed can invest in permanent structures like greenhouses or irrigation; a youth with a title can secure a loan to start a digital agency.This program doesn’t just give paper; it gives economic power.
